General Terms, Copyright & Proprietary Rights
Magicalkingdom.net belongs to the Magical Kingdom network and is owned and operated by the trading company Magical Kingdom. (referred to as "Magical Kingdom", "we", "us", or "our" herein). All online materials including greeting cards, invitations, ecards, printable templates, stationery, clip art, craft projects, educational projects, certificates, programmes, online graphics, Flash movies, streaming movies/video and interfaces may not be copied, reproduced, republished, uploaded, posted via e-mail, transmitted, or distributed in any way unless otherwise stated or a written permission has been granted by us. All other programmes, movies, videos, midi files, sound files, media files and games used, hosted, embedded, or linked to on our web pages are proprietary to their individual owners.
For purposes of this Agreement, the usage of our materials on any other Domains, Sub-domains, Web Pages, Networking Communities or networked computer environment is prohibited. All trademarks, service marks and trade names are proprietary to Magical Kingdom. All other trademarks, service marks and trade names mentioned via hyperlinks and or their related Web pages are proprietary to their individual owners.
Accessing and Usage
Visitors and non registered users by accessing, browsing the Web pages, downloading contents and/or using our Site facilities/programmes, you acknowledge that you have read, understand, and accept that you are bound by our Terms of Service and comply with all applicable laws and regulations. We do not make any claim or representation that the materials used at Magical Kingdom are politically, culturally or religiously appropriate and legal in other geographical locations or countries outside the United Kingdom. It is wholly your own decision, responsibility and discretion when accessing/using our Web site and using our materials for compliance with the laws and legislations of your country.
Members, registered users and affiliates must take time to read and understand our Terms of Service before registering for Magical Kingdom membership. By registering your membership with us, you accept that you are bound by a contract with us according to the terms of and conditions of this Agreement. This Agreement contains warranty disclaimers and other provisions which limit our liability to you. Please read this Agreement in its entirety. If you disagree to these Terms, please do not use this Site.
Although we endeavour to create materials to cater for all ages, cultures, sexes and denominations, some of our materials are of adult nature with sexually expressive images and or adult humour which could be conceived as culturally and or religiously inappropriate by some cultural and religious groups. These materials are excluded into confined areas of our Web Site. A prompt will forth warn you before entering into the adult areas. It is entirely your own decision, responsibility and discretion when accessing these areas. If you are easily offended, culturally and or religiously sensitive please do not enter these areas. It is also entirely your own decision, responsibility and discretion when using these materials that you would not use them to offend, abuse, antagonise, bully, harass, slander, defame or harm anybody emotionally or psychologically.
Printable Materials
The printable pictures, templates, concepts, designs and work sheets are intellectual properties of Magical Kingdom and its Associates. We grant you limited licence that you may download and print these materials for your personal and non-commercial purposes. Any actions such as removing the copyright notice, modifying the pictures in any way, republishing and reproducing for commercial purposes would be considered as violation of the owner's copyright.
Registration and Membership
In order to enjoy the full usage of our domain, you require becoming a paid member. As a paid member:
- Your membership will be covered for 12 months unless stated. Payment will be recurred after the 12 month period unless you cancel your membership before the 12 month period is up. If you have chosen to cancel your membership, your current membership will be continued until it is subsequently expired.
- You will require providing a valid email address for the confirmation of registration. Full access to domain contents can only be granted after confirmation of registration is completed. Accounts without a valid email address may be subjected to voiding of membership.
- You are entitled to choose your User Name and a password of your choice.
- Each member will allow using two IP addresses for entry to the member’s areas.
Acceptable Use Policy
- You may only use our domain in a manner that is acceptable and legal according to all applicable laws and regulations.
- You may not use our ecards or printable products to transmit chain letters, spam messages, viruses or other harmful, disruptive, or destructive files, advertisements, political, commercial or religious campaigns or any type of solicitation of any products or services.
- You may not use our printable card facility to copy, modify, publish, transmit, display, sell, distribute or reproduce copyrighted materials, trademarks or other protected proprietary information from us and/or other legal rightful owners without the express written consent of such materials from the original owner.
- You may not use our ecards and printable materials to send, communicate, publish or display any defamatory, slanderous, offensive, inaccurate, abusive, profane, obscene, sexually offensive, threatening, harassing, racial, or illegal materials and any other type of unlawful or unacceptable materials, as decided by the Magical Kingdom.
- You may not share your username and password to anybody.
- You may not use or steal other member’s password and/or user name.
- You may not in any circumstance mail/email our products when concealing or misinterpreting your true identity.
- You may not modify, decompile, reverse engineer, disassemble, or extract code, animation clips or artwork from our website including programmes, printable cards, or ecards without the prior written consent from us.
We will not in any way tolerate violations of the Magical Kingdom’s Acceptable Use Policy. Violation to our Terms and Agreement would be subjected to termination of membership without refund.
Disclaimer
Whilst we have taken all reasonable steps to ensure that the information, materials and services provided on this web-site is accurate, we cannot accept warranty and liability of any kind for any inaccuracies which may subsequently come to light.
Whilst we have taken all the reasonable steps to ensure that all the services we provide are in good working order and virus free, it is entirely your own decision and at your own risk when accessing/using of our facilities and or downloading any of our downloadable items. We cannot be held responsible directly or indirectly, in events of: hacker’s malicious attack, hardware or software failure; failure of ecards sent through our Website not reaching the intended recipients or reaching the recipients late; damage or loss of personal data through hardware or software incompatibility; unexpected virus infection or any other reasons that are beyond our control.
We cannot be held responsible directly or indirectly, in events of our printed or digital materials have been abused and misused by our users for: spamming; spreading political, racial and/or religious hatred; sending harassing and/or threatening messages; scamming or any unacceptable and illicit activities.
Example names, addresses and messages used on the greeting cards and craft templates are all fictitious creations. We cannot accept any liability for privacy infringement should subsequently come to light that there are similarity to somebody in real life.
It is entirely your personal responsibility to exercise your discretion and determine the appropriateness; racial, cultural, religious and political correctness for uploading photos/pictures and editing text messages when choosing our printed or digital materials. Magical Kingdom cannot be held responsible for your choice of our media and your edited contents, should the materials be conceived by your recipient subsequently as inappropriate, upsetting, political, culturally, racially or religious incorrect, offensive, harassing, profane or obscene.
